The Behavioral Scientist AI
Effective date: [the date it is published]
These terms are an agreement between you and Haystack Group LLC ("we" or "us") for The Behavioral Scientist AI at ai.thebehavioralscientist.com (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.
1. Your account
You must be 18 or older. Keep your account information accurate, and do not share your account. You are responsible for what happens in your account.
2. What the Service is
The Service gives AI-generated answers based on behavioral science research. Answers can be wrong, incomplete or out of date, so check them before you rely on them. The Service does not give medical, legal, financial, tax or other professional advice. You are responsible for your decisions and for how you use the answers.
3. Your content and our rights
"Your content" means what you enter in the Service and the answers you receive.
You keep any rights you have in what you enter. You grant us and our affiliates a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable and sublicensable license to use, copy, store, modify, create derivative works from, distribute, display and otherwise use your content for any purpose. This includes to provide and improve the Service, to train, fine-tune and evaluate AI models, to do research, and to develop new products. The license continues after you delete content or close your account. We handle personal information in your content as our Privacy Policy describes.
You promise that you have the rights needed to give us this license, and that your content does not break the law or anyone's rights.
You may use the answers you receive for any lawful purpose. Other users may receive similar answers.
4. Feedback
If you send us ideas or suggestions, we may use them in any way, without any duty to you.
5. Acceptable use
Do not:
- use the Service to break the law or to harm anyone;
- enter information about other people that you do not have the right to share;
- create accounts by automated means, or get around plans, limits or security checks;
- probe, scan or break the Service's security;
- copy, scrape, resell or reverse engineer the Service, or use it to build a competing product.
6. Plans, credit and payment
- Plans. The free plan includes a one-time credit. Paid plans are monthly subscriptions that charge usage below the standard rate. The prices and rates are on our pricing page.
- Usage. Each answer costs what its model usage costs at your plan's rate. A plan's monthly allowance resets each billing period and does not roll over. Credit that you buy separately is good for 12 months from purchase.
- Billing and renewal. A subscription renews automatically each billing period at our then-current price until you cancel. You authorize us to charge your payment method on file. If a payment fails, we may try again until it succeeds, and we may pause paid features until it does.
- Price changes. We will give you at least 30 days' notice before a subscription price changes.
- Cancellation. You can cancel at any time in the Stripe customer portal. You keep your plan until the end of the period that you paid for.
- Refunds. Fees and credit are non-refundable, and we do not give prorated refunds, except where the law requires them.
- Taxes. Our fees do not include sales tax, VAT or similar taxes. Where the law requires us to collect them, we add them to your charges. If you do not pay a tax that applies to your purchase, you are responsible for it and for any related penalties or interest. You make all payments without any deduction for withholding taxes; any such taxes are your responsibility.
- Payment processor. Stripe processes payments for us, and Stripe's terms and privacy policy apply to your payment information.
7. Suspension and ending
We may suspend or end your access at any time, including if you break these terms. You may stop using the Service at any time. Sections 3, 4 and 6 to 11 continue after your access ends.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not promise that the Service or its answers will be accurate, complete, uninterrupted or error-free.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the Service is limited to the greater of USD 100 or the amount you paid us in the three months before the event that caused the claim.
10. Indemnity
You will defend and compensate us for claims and costs that come from your content or your breach of these terms.
11. Governing law and disputes
The laws of the State of Tennessee govern these terms, without regard to conflict-of-law rules. Before you start a legal claim, contact us so we can try to resolve it informally. [Counsel to choose: the state or federal courts in [County], Tennessee, or binding individual arbitration with a class action waiver and a 30-day opt-out.]
12. Changes to these terms
We may change these terms. We will post the new version and update the effective date. For a material change, we will tell you before it applies. If you keep using the Service after a change applies, you accept it.
